Supervalu Truckers Lose 8th Circ. Appeal Over Fees

Law360, New York (August 11, 2011, 6:02 PM EDT) -- The Eighth Circuit on Thursday affirmed a lower court's dismissal of a putative class action brought by a group of contracted truckers seeking reimbursement of fees for loading and unloading their trucks at facilities belonging to grocery wholesaler Supervalu Inc.

The appeals court said that plaintiff Owner-Operator Independent Drivers Association could not sue under the Motor Carrier Act without showing that the truckers had not been reimbursed for the fees for "lumping," the term used to describe loading and unloading.
