Seagate Workers Can Bring Age Bias Action Over Layoffs

Law360, New York (August 15, 2011, 5:14 PM EDT) -- A Minnesota federal judge on Monday ruled that Seagate Technology LLC employees who lost their jobs through a round of layoffs can collectively sue for age discrimination, but excluded workers who opted for early retirement.

U.S. District Court Judge Michael J. Davis rejected Seagate's attempt to decertify the entire class of workers but decided that those who participated in a special incentive retirement plan were in different situations than employees fired through a mandatory plan for a companywide reduction in force, or RIF.
