Louboutin Takes Red Sole Mark Battle To 2nd Circ.

Law360, New York (August 15, 2011, 5:37 PM EDT) -- Christian Louboutin SA marched its red-soled shoe trademark to the Second Circuit on Friday, renewing its bid to bar rival Yves Saint Laurent America Inc. from selling similarly shod heels amid a dispute over whether one designer can monopolize a particular hue.

The French footwear designed filed a notice that it would appeal a New York federal judge's recent ruling denying Louboutin's preliminary injunction case and threatening to cancel the 2008 trademark.
