A&P, OfficeMax Strike Deal In Exec Poaching Suit

Law360, New York (August 15, 2011, 7:34 PM EDT) -- The Great Atlantic & Pacific Tea Co. Inc. on Friday told a New York bankruptcy court it had reached a settlement with OfficeMax Inc. in a suit alleging A&P improperly poached OfficeMax executives and interfered with their nonsolicitation agreements.

OfficeMax filed the underlying suit in Illinois state court in August 2010, claiming that former Chief Operating Officer Sam Martin, currently the CEO of A&P, had improperly recruited other OfficeMax executives, including Carter Knox, current A&P senior vice president of human resources, and Paul Hertz, current A&P...
