DynCorp Claims Drug Spraying Suit Preempted By US Law

Law360, New York (August 15, 2011, 7:31 PM EDT) -- DynCorp International Inc. on Monday in Washington again tried to shake a suit from a group of Ecuadoreans claiming injuries from an herbicide used in a drug eradication operation, saying the U.S. statute authorizing the operation expressly preempts the claims.

Also on Monday, DynCorp moved to exclude the testimony of the plaintiffs' sole expert witness, Michael Wolfson.

The suit, first filed in September 2001, seeks damages from DynCorp for injuries to the plaintiffs allegedly caused by a toxic herbicide sprayed on suspected drug farms in Colombia....
