Tobacco Makers Sue FDA Over New Warning Labels

Law360, New York (August 16, 2011, 9:15 PM EDT) -- R.J. Reynolds Tobacco Co., Lorillard Inc. and other tobacco manufacturers sued the U.S. Food and Drug Administration on Tuesday claiming new cigarette warnings violate the First Amendment by forcing tobacco makers to spread the government's anti-smoking message.

R.J. Reynolds, Lorillard, Commonwealth Brands Inc., Liggett Group LLC and Santa Fe Natural Tobacco Co. Inc. ask a Washington federal court for a preliminary injunction staying the implementation of the nine new graphic health warnings and for a declaration that the FDA's regulations are unconstitutional.
