Gov't Contracts Fraud Witness Keeps Immunity: 3rd Circ.

Law360, New York (August 17, 2011, 7:52 PM EDT) -- The Third Circuit on Wednesday declined to revoke judicial immunity for a construction supplies company co-owner accused of having abused the government's equal opportunity contract award program, saying it lacked authority to issue such a ruling.

The three-judge panel said a Pennsylania district court had not erred in granting Schuylkill Products Inc. co-owner Ernest G. Fink judicial immunity when fellow Schuylkill principal and co-defendant Joseph W.
