Ex-Brayton Purcell Clerk Can't Shake OT Exempt Status

Law360, New York (August 18, 2011, 4:31 PM EDT) -- A California appeals court ruled Wednesday that a former Brayton Purcell LLP law clerk who had graduated law school but not yet passed the bar was exempt from state overtime pay requirements as a worker engaged in a learned profession.

The appeals court affirmed a lower court's grant of summary judgment to the personal injury law firm, holding that Brayton Purcell had properly classified former law clerk Matthew Zelasko-Barrett as exempt from overtime pay.
