Teva, Novartis To Compete For Generic Lotrel

Law360 (June 11, 2007, 12:00 AM EDT) -- A federal court judge on Monday lifted a restraining order which prevented drug maker Teva Pharmaceutical Industries Ltd. from distributing a copycat version of Novartis AG's Lotrel, allowing both companies to compete in the generic market for the hypertension drug.

U.S. District Judge Harold A. Ackerman vacated the order and denied Novartis' request for a preliminary injunction against Teva distributing a generic version of Lotrel, ruling that the Swiss pharmaceutical company had failed to show that Teva's non-infringement defense lacked “substantial merit.”
