Michaels Seeks Slashed Duty In Chinese Pencil Suit

Law360, Los Angeles (August 18, 2011, 7:38 PM EDT) -- Michaels Stores Inc. hit U.S. Customs and Border Protection with a suit Thursday accusing the agency of improperly liquidating shipments of Chinese cased pencils purchased by the arts and crafts retailer at a China-wide rate of 114.9 percent.

Michaels claims in its U.S. Court of International Trade suit that the correct markup should have been lower exporter-specific rates instead of the higher China-wide duty.

The U.S. Department of Commerce improperly ordered CBP to use the higher rate, according to the suit.
