NJ Court Revives Drinker Bid For State's Exxon Docs

Law360, New York (August 19, 2011, 5:59 PM EDT) -- A New Jersey appeals court ruled Thursday that a state public records law didn't entitle Drinker Biddle & Reath LLP to unfiled deposition transcripts of Exxon Mobil Corp. experts in a government pollution lawsuit, but it revived a common law right-of-access claim.

While holding in favor of the state that the Open Public Records Act exempted unfiled discovery from disclosure, the three-judge Appellate Division panel reversed the dismissal of the law firm's common law demand for the transcripts, finding that the trial court's analysis wasn't thorough...
