Judge Lifts Marcal Stay For Personal Injury Claim

Law360, New York (June 12, 2007, 12:00 AM EDT) -- A bankruptcy judge has lifted the automatic stay in the Chapter 11 case of Marcal Paper Mills Inc. to allow a couple to pursue a personal injury claim.

In a ruling Monday, Judge Morris Stern of the U.S. Bankruptcy Court of the District of New Jersey allowed the stay in the case to be lifted, but only to fix an amount, if any, to the couples claim, and to resolve all issues related to insurance coverage and indemnification.
