Breitbart To Retry Anti-SLAPP Bid On Appeal

Law360, New York (August 22, 2011, 7:25 PM EDT) -- Political commentator Andrew Breitbart plans to challenge a federal judge's refusal to apply the District of Columbia's new anti-SLAPP law to Shirley Sherrod's defamation suit, seeking permission Friday to appeal denials of both his dismissal requests together.

The motion asks U.S. District Judge Richard J. Leon to certify for appeal his July 28 ruling refusing to dismiss before the Friday deadline rolls around for Breitbart and his co-defendant Larry O'Connor to appeal the court's similar refusal to toss the case under the D.C. Anti-SLAPP Act....
