Merial Can't Force Recall Of Generic Flea Repellent

Law360, New York (August 24, 2011, 3:40 PM EDT) -- A Georgia federal judge ruled Tuesday he could not force two manufacturers to recall from retailers a generic version of Merial Ltd.'s Frontline Plus that the company claims infringes its patents covering the blockbuster flea and tick repellent for pets.

Tuesday’s order is the latest development in a long-running patent infringement suit in which Merial maintains Velcera Inc. and Cipla Ltd. worked together in order to sell their generic, PetArmor Plus, in violation of a 2008 judgment enjoining Cipla and any affiliates from infringing Merial’s U.S. Patent...
