Seller Of Counterfeit Chloe Handbag Found Liable

Law360, New York (August 24, 2011, 6:33 PM EDT) -- The operator of a company that sold one counterfeit version of a Chloe SA handbag is liable for trademark infringement, a New York federal judge ruled Tuesday in a suit the Second Circuit reinstated with a notable decision on jurisdiction in counterfeiting cases.

U.S. District Judge Richard J. Holwell ruled that Simone Ubaldelli, operator of Queen Bee of Beverly Hills LLC, is individually liable for infringement, finding that he was a "a moving, active, conscious force" behind the two-person company's infringement.
