6th Circ. OKs Atty Sanctions In Fifth Third Class Action

Law360, New York (August 24, 2011, 4:16 PM EDT) -- The Sixth Circuit on Wednesday upheld sanctions against a Cleveland attorney who refiled a Ponzi scheme-related class action against Fifth Third Bank NA after his first suit was dismissed with prejudice.

A three-judge panel said Daniel G. Morris deserved sanctions for bringing an intervenors' complaint against the bank even though the same court had dismissed similar claims against it the previous year.
