Mass. Asks To Join Healthpoint Fraud Suit Over Xenaderm

Law360, New York (August 24, 2011, 4:26 PM EDT) -- Massachusetts sought Wednesday to intervene in a U.S. Department of Justice suit claiming Healthpoint Ltd. caused Medicaid to pay $90 million in claims for bedsore ointment Xenaderm despite its ineligibility for coverage.

Massachusetts Attorney General Martha Coakley moved to intervene on behalf of the state in order to recover about $2 million paid for false claims submitted to the Massachusetts Medicaid program, MassHealth. The state claims the fraudulent submissions violated the Massachusetts False Claims Act and caused unjust enrichment for Healthpoint.
