Farmer Subclass Loses Bid To Regain Cert. In Milk MDL

Law360, New York (August 25, 2011, 6:14 PM EDT) -- A Tennessee federal judge on Thursday affirmed his decision to decertify a subclass of dairy farmers accusing Dairy Farmers of America Inc. of conspiring with other dairy processors to control the supply chain and prices for milk in the Southeast.

U.S. District Judge Ronnie Greer said in his decision that the plaintiffs — dairy farmers and retailers — did not provide sufficient evidence to completely eliminate the potential conflict of interest between the subclass of DFA farmers and the other subclass of independent farmers.
