Shoddy Lawyering Can't Kill Collection Suit: 7th Circ.

Law360, Chicago (August 26, 2011, 3:49 PM EDT) -- The Seventh Circuit on Friday revived an Illinois woman's suit accusing debt collection agency Harris & Harris Ltd. of unfair collection practices, finding the lower court improperly tossed the suit after her lawyer missed deadlines and pursued weak class action claims.

The three-judge panel found that U.S. District Judge Ronald A. Guzman improperly tossed plaintiff Mariana Kasalo's entire suit — which included a settlement-ready individual claim — without considering its other options for trimming the class claims or resolving the case outright.
