Merck's $32M Damages Nixed In Vioxx Wrongful Death Suit

Law360, New York (August 26, 2011, 7:10 PM EDT) -- The Texas Supreme Court on Friday ruled for Merck & Co. Inc. in a wrongful death suit related to the drug company's painkiller Vioxx in which the plaintiffs had originally won $32 million in damages.

The state supreme court said that plaintiff Felicia Garza and her family had not provided enough reliable scientific evidence that Vioxx caused 71-year-old Leonel Garza Sr. to die of a heart attack in April 2001 and are not entitled to any damages.
