CVS Asks High Court To Put W.Va. Drug Suit In Fed. Court

Law360, Washington (August 29, 2011, 1:09 PM EDT) -- CVS Pharmacy Inc. and five other national pharmacy chains this month asked the U.S. Supreme Court for another shot at getting West Virginia’s drug cost lawsuit against them removed to federal court under the Class Action Fairness Act.

West Virginia's suit alleges that the major chains violated state laws regulating pharmacies and unfair business practices when they failed to pass along generic-drug cost savings to consumers.
