Ortho-McNeil, Plaintiffs Skirt Calif. Venue

Law360 (June 13, 2007, 12:00 AM EDT) -- In the battle over jurisdiction in an Ortho Evra birth control patch suit, a California district court on Wednesday refused plaintiffs' request to remand the case to state court while it awaits word from the Judicial Panel on Multidistrict Litigation on whether the case will be consolidated.

The motion, made on June 4, asked Judge Samuel Conti of the U.S. District Court for the Northern District of California to transfer the case because the plaintiffs and defendants do not have diversity of citizenship.
