Law360, San Diego (August 30, 2011, 9:21 PM EDT) -- The National Labor Relations Board overturned a prior ruling involving Dana Corp. that had allowed for immediate challenges to the representative status of a union following voluntary recognition by an employer, in one of three major board decisions made public Tuesday that came out in favor of unions.
All of the 3-1 decisions, in which three Democrat board members made up the majority, overruled previous rulings that were handed down by a Republican-controlled board.
