Merck Sues Ky. AG For Using Private Firm In Vioxx Suit

Law360, New York (August 31, 2011, 3:59 PM EDT) -- Merck & Co. Inc. sued Kentucky Attorney General Jack Conway in federal court in mid-August, claiming Conway violated Merck's due process rights by using a private law firm to prosecute a Kentucky commonwealth claim in the sprawling multidistrict litigation over Vioxx.

Conway's suit, like other cases in the MDL, accuses Merck of lying to its customers about the dangerous side effects associated with the arthritis drug, including increased risk of heart attack and stroke. The complaint demands civil penalties of up to $10,000 per violation of...
