Merck, Others Can’t Dodge Jury’s Chromium Verdict

Law360, Washington (August 31, 2011, 6:09 PM EDT) -- Merck & Co. Inc. and two other companies lost their bid in California federal court Wednesday to dodge a jury verdict that chromium was present at a site they are accused of polluting, a setback in the first phase of multiphase litigation over the contamination.

The plaintiffs originally sued the Franklin County Water District in March 2007 over property damage caused by an April 2006 flood, and in September 2007 they added Merck, Amsted Industries Inc. and Baltimore Aircoil Co. Inc. to the suit, alleging long-term...
