Toyota Can't Force Arbitration In Prank Ad Campaign Suit

Law360, New York (September 1, 2011, 1:40 PM EDT) -- A California appeals court on Wednesday ruled that Toyota Motor Corp. could not force arbitration in the case of a woman who claims she was tricked into taking part in an emotionally distressing ad campaign for the Toyota Matrix.

The court found that the campaign's user agreement and its arbitration clause were void at inception because the user, plaintiff Amber Duick, did not know what she was agreeing to.
