9th Circ. May Decide Defunct DADT's Merits

Law360, Los Angeles (September 1, 2011, 6:28 PM EDT) -- Conservative gay advocacy group Log Cabin Republicans urged the Ninth Circuit on Thursday to continue with the government’s appeal of a lower court's strike of “don’t ask, don’t tell” and rule on the policy's constitutionality, even though it will be repealed Sept. 20.

“If this case is not decided on the merits and you do not affirm on the merits, the government will be unconstrained it its ability to reenact,” Log Cabin attorney Dan Woods told the appeals panel, asking them to reject a government request...
