Imperial, XL Resolve Refinery Explosion Coverage Row

Law360, New York (September 2, 2011, 3:44 PM EDT) -- Imperial Sugar Co. agreed Thursday to drop its suit accusing XL Insurance America Inc. of breaking an obligation to cover defense costs in two dozen personal injury cases stemming from a Georgia sugar refinery explosion.

In a stipulation, Imperial and XL said the year-old dispute should be dismissed without prejudice.

An explosion at Imperial’s Port Wentworth, Ga., facility in 2008 killed 14 workers and injured 36 others, and a government probe blamed the accident on poorly designed and maintained equipment caused sugar dust to accumulate. In...
