Suits Sent To Arbitration Should Be Stayed: 8th Circ.

Law360, New York (September 6, 2011, 9:26 PM EDT) -- The Eighth Circuit ruled Tuesday that cases sent to arbitration should be stayed rather than dismissed so that parties can later return to court if necessary, reviving a fair wage class action brought by SuperShuttle International Inc. bus drivers in Minnesota.

But in the same order, the Eighth Circuit also backed a lower court's decision to send the drivers into arbitration and waive their class action rights, forcing them to gain approval from the arbitrator to pursue their claims before moving forward with the case....
