Same-Sex Partners Entitled To Ariz. Benefits: 9th Circ.

Law360, New York (September 6, 2011, 4:50 PM EDT) -- The Ninth Circuit on Tuesday affirmed an Arizona federal court's decision to block a state law that would have kept state employees' same-sex partners from accessing health care benefits, saying it violated the plaintiffs' rights to equal protection.

The state of Arizona had claimed that the district court improperly recognized a constitutional right to health care and failed to note the cost savings that would come with a law limiting the number of people eligible for state employee health benefits.
