Tyco Unit Challenges OxyContin Patents

Law360 (June 15, 2007, 12:00 AM EDT) -- A Tyco International Ltd. subsidiary under attack by Purdue Pharma LP for allegedly infringing three patents for painkiller OxyContin has responded to Purdue's amended complaint, asking the court to declare that the patents are unenforceable due to inequitable conduct.

Mallinckrodt Inc. filed its answer and counterclaims on Thursday in New York district court, asserting three affirmative defenses and four counterclaims. Two of the counterclaims seek declaratory judgment of noninfringement, and the other two seek declaratory judgment of invalidity and unenforceability.
