France Wrongly Banned Monsanto Maize: EU High Court

Law360, New York (September 8, 2011, 3:41 PM EDT) -- Europe's highest court ruled on Thursday that France broke the law by banning the planting of Missouri-based Monsanto Co.’s genetically modified maize without first requesting action from the European Union.

The European Court of Justice found that France had enacted its 2008 prohibition on the cultivation of Monsanto's MON 810 maize — a genetically modified crop that is used in the EU as animal feed and is particularly resistant to certain parasites — under the wrong EU law.
