4th Circ. Nixes Challenges To Health Care Law

Law360, New York (September 8, 2011, 4:49 PM EDT) -- The Fourth Circuit on Thursday dismissed two challenges to President Barack Obama's health care overhaul, avoiding the constitutional questions at the heart of the cases but deepening a split among appeal courts that is likely to fast-track the reform to the U.S. Supreme Court.

A three-judge panel ruled in both lawsuits — one filed by Liberty University, the other by Virginia Attorney General Kenneth Cuccinelli — that the plaintiffs did not have standing to sue.
