9th Circ. Rejects Arminak Appeal In Antitrust Suit

Law360, Los Angeles (September 14, 2011, 7:27 PM EDT) -- The Ninth Circuit on Wednesday declined to hear Arminak & Associate Inc.’s appeal of a lower court decision limiting evidence in a long-running antitrust suit against MeadWestvaco Calmar Inc. for an alleged plot to monopolize the trigger sprayers market.

Arminak filed a petition June 16 seeking permission to appeal U.S. District Judge Cormac J. Carney’s ruling barring it from introducing evidence that five lawful actions taken by Calmar were part of the alleged monopoly plot.
