High Court Declines To Rule On FERC Refund Authority

Law360, New York (June 18, 2007, 12:00 AM EDT) -- The U.S. Supreme Court on Monday refused to hear a case which questioned the Federal Energy Regulatory Commission's authority to force power wholesalers to refund payments because of violations of the agency's reporting requirements regarding market-based power rates.

FERC now may decide whether California energy consumers are eligible for more than $2 billion in refunds due to alleged market manipulation of market-based rates during the 2000-2001 California energy crisis.
