Ex-Brocade CFO Asks To Dismiss Stock Options Case

Law360, New York (June 18, 2007, 12:00 AM EDT) -- As the criminal trial for the former chief executive of Brocade Communications Systems Inc. got underway Monday, the company’s former chief financial officer accused in a purported class action of receiving backdated stock options has asked for the case to be dismissed.

Antonio Canova, Brocade’s former CFO, sought the dismissal of the plaintiff’s second amended complaint with prejudice in the U.S. District Court for the Northern District of California on Monday, claiming that the plaintiff had failed to state a claim against him.
