Alleged Atty Conflict Delays Ky. Medicaid Fraud Case

Law360, New York (September 15, 2011, 6:33 PM EDT) -- A federal judge in Kentucky on Thursday put discovery on hold in a Medicaid fraud suit against a nursing home until a disqualification issue involving defense counsel's previous work as a prosecutor is resolved.

Prosecutors have objected to Kentucky nursing home Villaspring Health Care Center Inc.'s choice of counsel, Chris Melton of Weber & Rose PSC, who was an assistant attorney general. Melton, who worked in the Kentucky attorney general's Medicaid fraud office, had investigated Villaspring, the nursing home he now represents.
