Foam Cos. Lose 2nd Bid To Deflate Antitrust MDL

Law360, New York (September 15, 2011, 6:39 PM EDT) -- An Ohio federal judge refused again Thursday to nix a multidistrict antitrust litigation against polyurethane foam manufacturers, rejecting the defendants' efforts to take the dispute over the court's interpretation of pleading standards to the Sixth Circuit.

U.S. District Judge Jack Zouhary denied the manufacturers' motions to reconsider his July order ruling that the plaintiffs — who are accusing the companies of anti-competitive conduct based in part on an ongoing federal antitrust probe into the industry — had met the pleading standards under Twombly and Iqbal....
