EPA Didn't Consider Pesticide's Risk To Kids: 2nd Circ.

Law360, New York (September 16, 2011, 3:48 PM EDT) -- The U.S. Environmental Protection Agency illegally approved the use of a pesticide without adequately taking into account the health risks to children, the Second Circuit found Friday, ordering the EPA to review the rule.

The decision was a victory for the Natural Resources Defense Council, which has been fighting for the EPA to re-evaluate dichlorvos since 2006. The NRDC says the pesticide is too dangerous and should be banned outright.
