Calif. Court OKs Cops' Anti-SLAPP Defense In Bias Suit

Law360, Los Angeles (September 19, 2011, 4:06 PM EDT) -- A California state appeals court on Friday found that panel attorney Danuta Tuszynska’s gender discrimination lawsuit against the Riverside Sheriffs' Association can be attacked under a state law designed to stop lawsuits that chill free speech.

Reversing a trial court’s decision denying the RSA’s motion to strike the complaint under the state’s strategic lawsuit against public participation law, the Court of Appeal found Friday that the lower court’s ruling had improperly focused on the RSA’s alleged discriminatory motive, rather than the organization’s actual conduct.
