Chrysler Dealers Lost Chance To Fight Sale: 2nd Circ.

Law360, New York (September 19, 2011, 5:01 PM EDT) -- The Second Circuit on Monday affirmed the ruling of a New York federal judge ordering eight former Chrysler dealerships to abandon their efforts to force the new, post-bankruptcy carmaker to take them back on board.

The appeals court found that the dealers had missed their chance to appeal the underlying 2009 sale in bankruptcy court of the company's more desirable assets — which did not include them — to New Chrysler, which emerged from a two-year bankruptcy in 2009 as a joint venture with Italian carmaker...
