Buffett Says Infringement Is Martiniville's Own Fault

Law360, New York (September 19, 2011, 3:34 PM EDT) -- Singer-songwriter Jimmy Buffett hit little-known Florida restaurant Martiniville Liquor Bar & Kitchen with a trademark infringement and unfair competition suit Friday, alleging the name cuts too close to his own “Margaritaville” mark.

The mark is based on Buffett’s popular 1977 song of the same name and the singer says he has been using the "Margaritaville" mark for his line of products and services since as early as 1985, according to the suit.
