Bimbo Bakeries Burns Texas Drivers In FLSA Row

Law360, New York (September 22, 2011, 12:17 PM EDT) -- Bimbo Bakeries USA Inc. on Wednesday had most of an opt-in group of Texas delivery drivers tossed from a class action in Pennsylvania alleging the company misclassifies its drivers as independent contractors to deny them benefits and make them bear certain business expenses.

U.S. District Judge Mitchell S. Goldberg granted most of Bimbo's motion to dismiss the claims of the opt-in plaintiffs, after the Texas drivers refused to comply with court-ordered discovery, according to the order.
