Cracker Barrel Denied Coverage Of EEOC Suit Costs

Law360, New York (September 21, 2011, 9:40 PM EDT) -- A Tennessee federal judge has held that Cracker Barrel Old Country Store Inc.'s insurer is not responsible for its legal costs stemming from a U.S. Equal Employment Opportunity Commission lawsuit, according to a ruling made public Wednesday.

In dismissing the case on Sept. 16, U.S. District Judge John T. Nixon agreed with Cincinnati Insurance Co.'s argument that the restaurant chain could only be reimbursed for defense costs in litigation brought directly by its employees, meaning it did not apply to the suit brought by the EEOC,...
