Law360, New York (September 22, 2011, 8:58 PM EDT) -- A Kansas federal judge on Thursday gave preliminary approval to an amended settlement class regarding defendant Costco Wholesale Corp. in a multidistrict litigation alleging deceptive retail practices for selling fuel at a specified price without adjusting for temperature.
U.S. District Judge Kathryn H. Vratil previously denied final approval to a settlement with Costco in April 2010, saying the proposed agreement did not provide adequate representation for all class members in the MDL, who are spread across 20 states.
