Class Cert. Sought In Caterpillar Faulty Engine Suit

Law360, New York (September 23, 2011, 7:08 PM EDT) -- Robert Elliott Trucking Inc., which sued Caterpillar Inc. in February over alleged defects in truck engines, asked a South Carolina federal court on Friday to certify a class of affected truck purchasers.

Robert Elliott Trucking, a bulk hauler of wood and lumber, says Caterpillar knew about design or manufacturing defects in its Caterpillar C-13 and C-15 tractor-trailer truck engines, but refused to offer compensation to customers who suffered engine problems.
