Ark. Drivers Seek Class Cert. In Info-For-Sale Action

Law360, New York (September 26, 2011, 1:33 PM EDT) -- Arkansas drivers who accuse a Utah-based company of illegally purchasing personal information from the Arkansas Department of Motor Vehicles asked a federal court Friday to certify a class of more than 2 million people.

The Recall Center violated the Driver's Privacy Protection Act, which prevents companies from acquiring drivers' personal information from state databases without good reason, according to the plaintiffs. The Utah company allegedly resold the information to third parties, including marketers and criminals.
