Rose Acre Tells 7th Circ. Policies Cover Antitrust MDL

Law360, Chicago (September 26, 2011, 3:39 PM EDT) -- Rose Acre Farms Inc. told the Seventh Circuit on Monday that Columbia Casualty Co. and National Fire Insurance Co. of Hartford owed the egg producer defense coverage in a price-fixing multidistrict litigation under their policies' advertising liability provisions.

At oral arguments, Rose Acre attorney David Gauntlett told a three-judge panel that an Indiana district court erred when it ruled that the underlying complaints against Rose Acre are rooted in the Sherman Act and not covered under the policies.
