2nd Circ. Upholds Sokol Loss In Suit Over Kazakh Oil Deal

Law360, New York (September 26, 2011, 7:41 PM EDT) -- The Second Circuit on Monday backed lower court decisions that gutted Sokol Holdings Inc.'s lawsuit against BMB Munai Inc. over the acquisition of oil fields in Kazakhstan, agreeing that a failure to perform doomed Sokol's claim for tortious interference with a contract.

Sokol had accused BMB of disrupting a contract that would have given it a large stake in the energy venture, but Sokol didn't come through with a $700,000 payment that was part of the agreement. Sokol tried to point the finger at BMB-related defendants,...
