DOJ Doesn't Want 11th Circ. To Rehear Health Care Case

Law360, New York (September 26, 2011, 8:08 PM EDT) -- The U.S. Department of Justice declined Monday to ask the Eleventh Circuit to reconsider its decision striking down the federal health care reform law's mandate that citizens buy insurance, in a move suggesting the DOJ will take the case to the U.S. Supreme Court.

The Eleventh Circuit struck down the Patient Protection and Affordable Care Act's mandate that individuals buy health insurance or pay a penalty as unconstitutional in a 2-1 decision in August, mostly siding with 26 states that had sued to overturn the law....
